Defending a trademark
against third parties
The trade mark proprietor may prohibit a third party from using a trade mark identical or similar to his trade mark for the same or similar goods or services, if there is a risk of confusion for the public (exclusice right).
The proprietor of the trademark can enforce his right by an injunction in court (including preliminary injunction). The right of exclusion may be enforced by appeal to the relevant legal department or by a cancellation request to the Nullity Department of the Austrian Patent Office.
